The Construction Index registers over 160,000 operators who earned their ticket to employment by completing this course.

Construction site security should be at the top of your priority list. According to a study conducted by Allianz Cornhill, over £70 million worth of construction plant machinery, including excavators, compressors, and even cranes, are stolen from construction sites each year. The Construction Design and Management Regulations, better known as the CDM Regulations, established a standard of conditions for construction workers across the UK. If construction contractors fail to provide the welfare units outlined in the CDM Regulations, they can face fines or far worse.

Whether managing a large-scale industrial construction project or a small domestic job, you must adhere to the CDM legislation. The regulations cover almost all the most common construction tasks, and a few that might surprise you. 

Let’s examine the ins and outs of the CDM Regulations.

Everything You Need to Know About CDM Regulations

In 2015, the HSE published the CDM regulations and set a precedent for welfare facilities in construction. The regulations cover health, safety, and welfare. 

So, what welfare facilities are required on a construction site? 

• Toilet facilities
• Washing facilities
• Water 
• Rest areas
• Changing rooms
• Somewhere to eat and drink during breaks 

The HSE has attached extra guidance for a few of the requirements. For example, toilet and washing facilities must be “adequate”. The HSE goes on to explain what “adequate” means. 

• There are enough toilets and washbasins; people should not have to queue long to go to the toilet.
• Separate facilities for women and men where possible. If this is impossible, the facilities should have lockable doors. 
• Walls and floors should be tiled or covered in a suitable waterproof material to make them easier to clean.
• Consideration for the needs of those with disabilities. 

The HSE has different requirements for male and female toilets.

• There must be one toilet and washbasin for every one to five women at work.
• There must be one toilet and washbasin for every one to fifteen men at work.

Do You Always Need Welfare Facilities? 

The simple answer is yes. For every construction project, there should be adequate welfare facilities. 

It is important to remember that the CDM Regulations apply to construction work, not just construction projects. The term “construction work” covers a much broader range of tasks.

What Is Construction Work? 

According to the CDM regulations, “‘construction work’” means the carrying out of any building, civil engineering or engineering construction work and includes-

• (a) The construction, alteration, conversion, renovation, repair, or other maintenance (including the use of water or corrosive or toxic substances) decommissioning, demolition, or dismantling of a structure
• (b) The preparation of construction work for a structure, including site clearances, exploration, investigation, and the clearance or preparation of the site or structure for use in the future 
• (c) The assembly of prefabricated elements or the disassembly of prefabricated elements which formed a structure immediately before the disassembly
• (d) The removal of a structure or any product or waste resulting from the demolition or dismantling of a structure 
• (e) The installation, commissioning, maintenance, repair, or removal of mechanical, electrical, gas, compressed air, hydraulic, telecommunications, computer, or similar services that are typically fixed within or to a structure  

There are only two caveats. Subsection (b) does not include site surveys or archaeological investigations. Neither is classed as construction preparation work. Therefore, they are not subject to the HSE’s regulations. 

HSE Welfare Facilities Fines 

If you fail to provide adequate HSE welfare facilities, you risk receiving a sanction, including fines, disqualification, and even imprisonment. 

The fines vary, although it has been reported that one construction firm was fined a massive £20,000. Toft Construction Limited, a firm based in Greater Manchester, was working on a domestic property in Salford when an HSE inspector arrived. Among other things, the inspector discovered no toilets or washing facilities for workers on the site. 

In court, Toft Construction Limited was found guilty of breaching Regulations 15(11) and Regulation 2 of the CDM Regulations. The company was fined a total of £20,000 and forced to pay an additional £5,176.90 in expenses. 

This is not the first or last time the HSE has fined a company for flouting the rules in the CDM Regulations. 

Who Is Responsible for Welfare Facilities on Site? 

Given the gravity of the CDM regulations, it is no surprise that liability is a big talking point. ”What welfare facilities must a sub-contractor supply?” is one of the most common questions on site. 

Contractors are responsible for providing welfare facilities on-site, but clients must ensure that the welfare measures are in place. 

• Commercial clients must check that contractors have arranged the proper welfare for their workers. 
• Contractors must provide the proper welfare for any workers under their control when they are on the site. 
• Principal contractors have the same responsibilities as contractors but must ensure the welfare requirements are in place for the entire project. 

Hiring Welfare Units 

To comply with CDM regulations, you must have enough welfare facilities for your workers. The facilities must be adequate and accessible. 

During the project planning stage, you should include details about the welfare facilities you will provide. The layout of your site, the size of your workforce, and the nature of the work will determine the number and location of welfare facilities.

It is not uncommon for contractors to realise they need extra facilities mid-way through a project. New tasks could require extra workers, meaning you need to increase the number of welfare facilities on-site. Tasks that include hazardous waste substances may require a separate decontamination unit, which falls under the remit of washing facilities. 

Remember, welfare facilities must be available from day one of a project, so plan ahead and make the necessary arrangements before sending workers to your site.

Why Is Workplace Hearing Protection So Important?

When you’re putting together a health and safety policy for your construction site, it can be easy to only focus on the hazards you can see.

However, it’s equally as important to focus on the hazards you can hear, as this can be very damaging to the safety of your employees. Whilst noise control isn’t always top priority, it has to be taken as seriously as any other workplace hazard as loud conditions in the workplace can lead to serious health problems for workers.

As noted by Health and Safety England (HSE), industries with the highest risk of work-related hearing problems include the extraction energy and water supply sectors, as well as the manufacturing and construction field.

Loud noise at work can lead to temporary deafness, but prolonged exposure can lead to permanent hearing damage, which is why workplace hearing protection is so important.

Under HSE regulations, all businesses are required to:

• Provide employees with hearing protection when the noise level in the workplace exceeds a certain level, or when specifically requested. They must also ensure these protectors are properly used and maintained.
• Identify hearing protection zones, which are areas where the use of hearing protection is mandatory. They should also mark these zones with signs where possible.
• Provide all employees with training and information on how to use and care for their hearing protectors.

What Is Considered a Safe Level of Noise?

As a construction manager, you need to assess or estimate noise levels for different sites so that you can put appropriate controls in place.

The Noise Regulations define ‘exposure action values’, which are levels of noise exposure which, if exceeded, require you to take specific action.

Let’s take a look in more detail.

• Lower exposure action value – daily or weekly personal noise exposure (LEP,d or LEP,w) of 80dB. As a general rule of thumb, the noise level is probably 80db or more if the noise is intrusive but normal conversation is possible between people 2 m apart – comparable to a busy street, a typical vacuum cleaner or a crowded restaurant.
• Upper exposure action value – daily or weekly personal noise exposure (LEP,d or LEP,w) of 85dB. As a general rule of thumb, the noise level is probably 85 dB or more if it is necessary to shout to talk to someone 2 m away, for more than about two hours per day in total.
• Peak sound pressure – these very loud ‘impact noise’ levels can be more damaging than the daily / weekly noise exposures and present a risk of immediate and permanent hearing loss. The lower and upper action values for these are 135 and 137 dB (LCpeak) respectively. Damage caused by them will be in addition to any damage resulting from the daily / weekly noise burden.

If your employees are likely to be exposed to noise at or above the upper exposure action value, then you must take action to ensure their hearing is not damaged.

What Are the Signs of Hearing Loss?

There are many signs of hearing loss and your quality of life can be greatly affected.

Below are some of the most common signs of hearing loss:

• Conversation becomes difficult or impossible
• People have trouble using the telephone
• They find it difficult to catch sounds like ‘t’, ‘d’ and ‘s’, and so confuse similar words
• They may suffer from permanent tinnitus (ringing, whistling, buzzing or humming in the ears) which can lead to other problems, including depression and loss of sleep
• Their family complains about the television being too loud

It’s important you identify these signs early on, as it increases your chance of being able to correct any hearing problems.

Common Types of Noise Hazards On a Construction Site

A construction site is always going to be a loud place to work, even when precautions are taken.

Regular 8-hour exposures to 85 dBA can damage your hearing. The higher the noise level, the faster the hearing loss.

So, what are some of the common causes of noise on a construction site?

Metal chop saw

This tool is used for cutting metal pipes and steel sections. However, these saws are extremely loud and generate a great deal of metal dust. Therefore, correct hearing protection is required when using a metal chop saw, such as ear defenders or ear plugs.

Chainsaw

On average, a chainsaw runs at approximately 106 decibels, which is around 8 times louder than a conversation. However, for the most part, chainsaws run at around 120 decibels at their loudest, which is 32 times louder than a conversation. Therefore, hearing protection must be worn to prevent long term hearing loss.

Hammer drill

Hammer drills drill holes and drive screws. However, they can also bore holes through concrete, brick, stone and other masonry materials. As such, they generate noise at a level of around 85 decibels, which is almost enough to cause hearing impairment.

Welding machine

All welding machines generate noise but some processes are much noisier than others are, such as plasma cutting. Likewise some welding machines are noisier than others and some generate noise of a higher frequency.

Concrete mixer

A concrete mixer combines large amounts of concrete and cement in an easy way. During operation, they run at a level of around 85 decibels. Therefore, constant exposure to this level of noise can result in long term hearing problems.

How to Keep Your Employees Safe

As a construction manager, your team is your responsibility. Whilst they are at work, it’s your duty to make sure they are safe, otherwise you could end up with lots of employees on the sick.

As we’ve touched on, your employees need to have the correct PPE to ensure they are safe throughout the working day.

Always Read the Manual

When using any piece of equipment, reading the manual first should be standard. This provides tool specific information including handling, usage, warnings, and maintenance procedures to ensure the highest level of safety.

Make sure you have a good understanding of how the tool works and what materials it can be used on. Familiarise yourself with this information before using the air tool.

If you have any concerns or questions, speak to the manufacturers customer service department who will be able to help. Never assume or guess when using these pieces of equipment as it’s always best to be sure.

You should maintain all tools in line with the manufacturer’s guidance, and only replace/ repair the tool using parts recommended by the manufacturer. This helps to ensure the product won’t fail and will serve you for a long time.

Check the Air Pressure

Always check the manufacturer’s settings. If an air tool’s flow or pressure is higher than what the manufacturer’s rating states, it can result in excessive torque. This causes the tool to break and can potentially lead to serious injuries.

You can prevent this from happening by making sure the air pressure corresponds to the manufacturer’s rating before powering up the tool.

This isn’t a time consuming exercise and can prevent a huge safety risk so never miss this step before using an air tool.

Always Wear Safety Glasses or a Face Shield

If you’re operating a pneumatic tool for a long period of time, you should wear hearing protection to prevent your ears from being damaged. This can prevent serious hearing problems and deafness as pressurised air generates unhealthy noise levels.

Even if you’re not operating the air tool, but you’re working in the surrounding area, then hearing protection is advised as you are still exposed to the loud noise. Employers should supply hearing protection to all employees working with or beside these tools.

You should also make sure that you’re wearing the hearing protection correctly, ensuring that it fully covers your ears. This increases the chance of protecting your ears from hearing loss.

Be Aware of Oil

If your air tool isn’t properly maintained, its performance will be reduced meaning it could take longer to complete a job.

When air tool performance is weak, a common solution is proper lubrication. Pneumatic tools should be lubricated with oil on a regular basis as this reduces friction and prevents water contamination. In particular, tools which are frequently used should be oiled daily. Lubricate the air tool by adding a few drops of tool manufacturer-approved oil into the air inlet connection.

However, be careful not to over lubricate as oil won’t compress. This means any excess oil inside of the air tools can cause failure or lead to reduced performance. It’s also essential you use the right oil as seals can become damaged when the wrong oil is used.

Refer back to the manual as different oils and lubricants are recommended by tool manufacturers.

Never Carry Air Tools by the Air Hose

Always carry air tools by their handles.

If you carry an air tool by the hose, it puts unnecessary pressure and stress onto these components, which can lead to early failure and/or injury.

Moreover, you run the risk of the hose becoming disconnected or damaged. If this happens and you power up the tool, the hose will begin to whirl around uncontrollably. This creates a serious safety risk to both yourself and those around you.

You should always take good care of the air hose as this helps promote tool performance and reduced maintenance. When using a hose, make sure the connections fit properly and are equipped with a mechanical means of securing the connection, such as a chain, wire or a locking device.

You should also turn off air pressure to the hose when you’re not using it as this prevents accidental discharge from occurring when you are either taking a break or have finished working for the day. As mentioned earlier in the post, never operate the air tool at a pressure above the manufacturer’s rating as this can be a safety hazard.

Wear Gloves

Under certain conditions, the temperature of compressed air can be low enough to cause frostbite, stiffen the operator’s fingers, or even result in cumulative trauma injuries. In these scenarios, the operator is advised to wear gloves providing there is no risk of them getting caught in any rotating or reciprocating parts.

However, gloves should only be worn under these conditions as they can impact a worker’s handling of the tool. If possible, delay using the air tool until conditions improve.

When you’re wearing gloves and operating machinery always make sure you have a good grip as this ensures the tool is handled correctly.

Focus

Focus is key when you’re working on a construction site. With any piece of machinery it’s important you concentrate whilst it’s in operation, and always make sure to direct the tool at the designated area. Never point it towards another person, or even your own clothing as even at low pressure, this can cause serious damage.

Regardless of the tool you’re using, always focus on the job at hand whilst it’s in operation and never make any careless movements. This could put both you and other workers in danger, so always act responsibly.

Also, never remove or modify safety devices. Any sort of alteration/ tampering to the trigger or other components will significantly increase the chances of injury or accidental firing of the tool.

Be Aware of Tripping Hazards

When carrying air tools around a construction site, you need to be aware of potential tripping hazards. Especially when you’re moving pieces of machinery around, make sure your pathway is clear and any obstructions have been removed.

This includes but is not limited to wires, wooden panels, uneven surfaces, and loose cabling. Trip hazards can also be caused by hoses laid across walkways or curled under foot so always check the surrounding area before carrying an air tool.

It’s very important that you wear appropriate footwear when using air tools as this will prevent you from slipping on different surfaces. On a construction site, you must wear steel toe capped boots as this protects your feet from injury and gives you a firmer grip on the ground.
